If you’re looking to pursue a career in entertainment for your child or if you are an entertainment industry professional looking to employ a child in your production, it is important that you know the child actor labor laws in both your home state and any state in which you intend to work.

    Although minors employed in entertainment are exempt from standard child labor laws in the state of Louisiana, provided such performance is not detrimental to the health or morals of the minor, production companies are required to obtain necessary permits prior to the start of employment.

    Typical work permits are not required for minors working in entertainment in the State of Louisiana, however written consent of the parent or legal guardian must be provided to the employer as part of the Employer’s permitting or waiver application process as well as a copy of the minor’s proof of age.

  • YES

    The state of Louisiana requires employers to obtain a blanket permit to employ minors in the entertainment industry. The application for the permit should be submitted by the employer at least thirty-six hours before the minor is scheduled to begin work and be accompanied by a Workers Compensation Certificate as well as a signed parental consent form and minor’s proof of age. The application shall specify the projected dates of employment, the approximate number of minors to be employed and the age of all minors.

    Under certain circumstances, the Director of the office of Workforce Development, in his discretion, shall have the authority to authorize the issuance of a Theatrical Waiver to employers of minors desiring employment outside the normal time constraints. Waiver requests must also be accompanied by parental consent and an explanation of why the waiver is necessary. 48 hours advance notice via email is required.

    Every contract shall require that 15% of gross earnings be placed in trust and blocked until age 18. In Louisiana, financial institutions may charge “reasonable” fees. Louisiana Revised Statutes §2133

    If a minor is absent from school for two or more days within a thirty-day period, the employer shall provide a certified teacher, beginning on the second day of employment for a minimum of three hours education per day. One teacher per ten kids. Louisiana Revised Statutes 51:2134

    The state of Louisiana does not require talent agents to hold talent agency licenses, employment agency licenses or to be bonded by the state.

    The state of Louisiana recognizes graduated minors as exempt from hourly restrictions, meaning that graduated minors could work before 6 AM or after Midnight.

    Graduated minors are not however exempted from any other Louisiana statute. Work permits and trust accounts are still required. Maximum hours per work day are still limited by age.
