    The State of South Dakota follows the Federal guidelines regarding employing children in entertainment. Per the FLSA, minors employed as actors or performers in motion pictures, theatrical, radio, or television productions are exempt from standard youth employment provisions. However, the State of South Dakota’s compulsory attendance laws require that any minor who misses school make up the number of hours missed.

    The State of South Dakota’s compulsory attendance laws [SDCL 13-27] require that persons aged 6 to 16 must not miss any schooling for any reason. Any regular school time missed must be made up with either an on-set teacher or through independent study which equals the amount of time a minor would spend at school. The minor’s parent or guardian should contact the child’s school district should before any school is missed, and give the employer advance notification of any educational requirements.

    If an Application for Public School Exemption Certificate is requested, the form must be completed by the parent or guardian, notarized and submitted to the minor’s school district with a certified copy of the child’s birth certificate.
